Ben & Jerry's Sales Grow 9.2% in Q2 2026 Amidst First Year of Ownership Conflict Under Magnum

One year ago, on September 17, 2025, Jerry Greenfield resigned from Ben & Jerry's after 47 years, stating he was "silenced, sidelined". Since then, the Ben & Jerry's Foundation has been defunded and is closing after distributing $60m to grassroots groups, 100,000 petition signatures were refused by Magnum, and seven of ten legal claims against the owner were dismissed. Yet, on Magnum's own H1 report, Ben & Jerry's grew 9.2% in Q2 2026, while the group grew 4.7% across the half, showing its commercial strength persists despite the conflict.

One year ago this Thursday, on 17 September 2025, Jerry Greenfield resigned from Ben & Jerry's after 47 years. His letter, posted on X by co-founder Ben Cohen, said the brand had been "silenced, sidelined for fear of upsetting those in power" and that he could not stay "in good conscience". Behind the letter sits the April 2000 agreement, in which Unilever paid $326m and signed up to an independent board with the social mission in its charter. That arrangement is now a federal case: in August a New York judge dismissed seven of the board's ten claims against the owner, and three continue. In July the Ben & Jerry's Foundation, which has moved $60m to grassroots groups over 40 years, said it will close at the end of 2026 after its funding was cut and staff were ordered out of their South Burlington office, taking around $600,000 a year of Vermont grants with it, per VTDigger. A Magnum spokesperson told the same outlet the shutdown is "entirely down to the Trustees and their decision to ignore audit findings". Ownership passed to The Magnum Ice Cream Company when Unilever's ice cream division listed in Amsterdam on 8 December 2025. On listing day, chief executive Peter ter Kulve told the Financial Times the founders' dedication "has been enormous, but at some point you have to let it go", and told the Dutch paper FD the campaign was "just noise". Ben Cohen launched the Free Ben & Jerry's campaign on 9 September 2025 outside Magnum's Capital Markets Day in London, and on 7 April 2026 delivered 100,000 petition signatures to Magnum's Amsterdam headquarters, where no one would accept them. He told Fortune in August: "They ain't got no soul. The only mission these guys have is profit." Through all of it, the ice cream kept selling. Magnum's own first-half report shows Ben & Jerry's grew 9.2% in the second quarter against 4.7% for the group across the half, with Free Cone Day alone serving more than a million scoops, a performance ter Kulve's own statement framed as helping the group "outperform the growing global ice cream category". The 2000 merger clause, which established the independent board and enshrined the social mission, was for 26 years seen as a unique aspect of the deal. The first year of open conflict has transformed it into a live test case for whether a social mission can survive its acquirer, with commercial performance suggesting its enduring appeal despite legal and operational challenges.

Trend context

The anniversary lands Thursday 17 September and the desks will file that week. The wider cycle: purpose-brand ownership fights are the running business story of 2026 (Fortune has run two essays on B&J alone, 7 May and 7 Aug), and Magnum is a newly listed company (8 Dec 2025) whose first-year story IS this fight.

About Ben And Jerrys

Why we exist

Ben & Jerry's was built on linked prosperity: the ice cream pays for the arguing. Fairness is a recipe cost like cream, and the company said so on the tub for 47 years. The founders' bet was that customers would fund a conscience if the ice cream was good enough. Twenty-six years after selling, the bet is still paying, on the owner's own numbers.

How we do it

An independent board with the social mission written into the 2000 merger agreement — governance as a preservative. A foundation funded from the business, $60m to grassroots groups over 40 years. Activism carried on the product itself, flavour by flavour, so the politics ships in the freezer aisle. The architecture is so unusual that 26 years later it is still being litigated; that is why year one of the war is a story.

What we do

Ben & Jerry's produces premium ice cream, known for its unique flavors and social mission. Since December 8, 2025, it has been owned by The Magnum Ice Cream Company, a spin-off from Unilever.

Why it matters

The enemy is the acquisition promise that dies after the founders' shares clear — buy the halo, mute the voice. The victims are named: grassroots groups losing ~$600k a year in Vermont grants when the foundation closes, and every founder now negotiating a sale who will be shown this case as the reason clauses don't work.

Who it's for

The shopper who pays £6 a tub partly to vote — the customer for whom Phish Food is the one purchase where the politics is the point, and who wants to know if that still means anything under Magnum.

Proof points

Q2 2026 growth 9.2% vs group 4.7% H1 (Magnum H1 report, 30 Jul 2026). Foundation: $60m over 40 years; ~$600k/yr Vermont grants at risk; closing end-2026 (VTDigger, 15 Jul 2026). Free Cone Day 2026: 1m+ scoops (Magnum H1). 100,000 signatures delivered 7 Apr 2026, not accepted (campaign's own milestone log). Court: 7 of 10 claims dismissed, 3 proceeding (reports of 22–24 Aug 2026 ruling, SDNY). Sale: $326m, April 2000.

Traction & credibility

Two Fortune features in 2026; Bloomberg, CNBC, AP, NPR coverage across the year; a federal docket; a listed parent whose own results carry the brand's numbers.

Scar: took the job mid-July 2025, between the campaign launch and the resignation — the man hired to hold a brand at war with his own employer. Advantage: seven earlier years inside B&J including MD Europe; he knows the mission machinery from the inside. Pivot: from Unilever foods career back to the tub, in wartime.

Co Founder

Founded Ben & Jerry's with Jerry Greenfield in 1978 in a renovated Burlington gas station and sold it to Unilever in April 2000 for $326m, with the independent board and social mission written into the agreement. No longer a company employee (Fortune, August 2026). Launched the Free Ben & Jerry's campaign on 9 September 2025 outside Magnum's Capital Markets Day in London, and delivered 100,000 petition signatures to Magnum's Amsterdam headquarters on 7 April 2026.

The insight

Ben & Jerry's sales grow 9.2% in Q2 2026 despite ownership conflict in first year under Magnum

benjerry.com

The story

One year after co-founder Jerry Greenfield resigned saying the brand had been "silenced, sidelined for fear of upsetting those in power", the first full audit of the ownership war shows a paradox on the owner's own books: Ben & Jerry's grew 9.2% in Q2 2026 while its foundation was defunded, its petitions refused, and seven of its board's ten legal claims dismissed. The 2000 merger clause that created its independent board is a governance experiment so unusual it is still being litigated 26 years on, and year one of its stress test just produced data.

Why it matters

Every founder selling a mission-led company is told the values will be protected by contract. This is the live test of whether that is ever true, and the interim answer — the mission outgrows its muzzle commercially while losing to it legally — reframes how purpose brands get bought and sold.

Who does it impact

Shoppers who buy the politics with the pint learn whether the label still means anything; Vermont grassroots groups lose ~$600k a year when the foundation closes at New Year; founders and investors across food and beauty recalibrate what a social-mission clause is worth; a newly listed Magnum learns its most contested brand is also its Q2 growth story.
